Complications aren’t always a result of medical malpractice

As a medical provider, you know that you always do your best for your patients. As a result, you rarely have any issues that arise.

Unfortunately, one of the last patients you had suffered from complications during surgery. He believes it’s a result of your actions, while you believe that his body had a reaction that you could not have predicted.

You know the man intends to file a lawsuit for medical malpractice. How can you defend yourself?

There are a few ways. The first, and probably the most obvious, is to make sure the patient understands that you did deliver the expected care for the situation. For example, if he or she had an allergic reaction to a drug he or she didn’t list as an allergy, you didn’t violate any protocols by giving the patient the drug. Likewise, if you treated the allergy promptly, the patient shouldn’t be able to claim for negligence or neglect.

Another thing to consider is if you took an unusual approach to a medical problem. If you did, you may need to take time to better explain why you took those actions instead of standard procedures. For example, if a treatment you provided was at the forefront of medical technology and one that you had special training in, you would be able to defend your use of the technique. This is especially true if you informed the patient of the risks prior to using this unique treatment plan.
