“Negligent Security” often results when a person is physically attacked while on someone else’s property if the crime was foreseeable to the property owner and the property owner failed to take steps to minimize or eliminate the crime.
Tragically, such crimes may include murders and rapes. These assaults and attacks can occur in a variety of settings including apartment buildings, bars, shopping centers and malls, hotels and motels, amusement parks, school campuses, and even private homes.
In most cases, the personal injury attorney works closely with a security expert or consultant to determine whether the crime was foreseeable. This determination is ultimately made by the trier of fact (whether judge or jury) based on several factors including the history of crime at or near the property, the presence or lack of presence of a security guard, the lighting conditions, and the presence of other security measures such as fencing, surveillance cameras, and/or alarms.
